Avery is one of Voldemort's Death Eaters in both the First and Second War. He is of roughly the same age as Severus Snape and the Marauders. It is probable that he is the son or close relative of Avery, Sr., who was a schoolmate of Voldemort (HBP23).
Avery went to Hogwarts, where he was Sorted into Slytherin and part of a group of Slytherins who nearly all became Death Eaters later. Group members as remembered by Sirius Black twenty years later include Severus Snape, Rosier, Wilkes, Bellatrix Black and Rodolphus Lestrange (GF27). From what Harry Potter sees of Snape's memories in the Pensieve, Avery was especially close to Snape and Mulciber, and played some nasty tricks on other students. Lily Evans described his idea of humour as "just evil" (DH33).
At some point Avery became a Death Eater. After the end of the First War, he claimed that he had been put under the Imperius Curse by Voldemort. As a result, he was not apprehended (GF27).
Avery belonged to those Death Eaters who immediately Apparated to the Little Hangleton graveyard when their old master called. During Voldemort's speech in which he reprimanded his followers for their abandonment, he broke out of their circle and flung himself before Voldemort's feet to beg for mercy for all of them. Laughing, Voldemort let him suffer the Cruciatus Curse. When he finished, Avery lay gasping on the ground. Voldemort ordered him to stand up and told him that he would not forgive before thirteen years of repayment for the thirteen years that had passed since his fall. He then turned to address the other Death Eaters separately adn explained how he had managed to return. Avery watched as Voldemort tortured Harry Potter and challenged him to a duel to show that the boy's escape had been mere luck (GF33). He closed ranks with his fellow Death Eaters to form a tight circle around the two opponents. Together, they laughed when Voldemort taunted and humiliated the boy. Voldemort's and Harry's spells met in mid-air and they were lifted from the ground to another spot that was clear of graves. Confused, the Death Eaters followed and reformed the circle around the two figures, shouting for instructions. Some drew their wands. Harry and Voldemort were surrounded by a cage of light and the Death Eaters continued shouting, but Voldemort told them not to do anything. They watched as the reverse spell effect made echoes of Voldemort's last victims appear and crowd their master. When Harry finally broke the connection and started to run, two of them were so stunned that he merely knocked them aside. The others followed, shooting curses. Voldemort told them to stand aside so that he could killed Harry himself, but before he could cast the curse, Harry used the Triwizard Cup Portkey and disappeared (GF34).
When Voldemort tried to steal the prophecy from the Department of Mysteries, Avery told Voldemort that Broderick Bode, who worked for the Department, would be able to remove it. Acting on this information, Voldemort had Bode put under the Imperius Curse, but when the Unspeakable tried to remove the prophecy, he was badly injured and sent to St. Mungo's. Augustus Rookwood, a Death Eater who had been working for the Ministry of Magic during the First War, told Voldemort that Bode could never have taken the prophecy after his escape from Azkaban. In consequence, Voldemort tortured Avery (OP26).
Avery was part of the group of Death Eaters who participated in the Battle of the Department of Mysteries (OP35). He was probably caught and sent to Azkaban at the end of the battle (OP36). In that case, it is likely that he escaped from Azkaban during the mass breakout that was hushed up by the Ministry, together with his fellow Death Eater inmates (DH5).
